How to protect your rights in case your project is under liquidation at the Real Estate Court Committee?

Once a real estate off-plan project gets listed in the Court Committee, the project can get liquidated through auction or reactivated with the same developer or a new developer.

What to do in case of Liquidation?

In the best case scenario, the developer has already submitted to the Real Estate Court Committee all required documentation related to the clients inventory of the project being liquidated.

Unfortunately, most of the clients’ data of the projects listed in the Court Committee is not up to date and can have errors or even missing information, and in a lot of cases existing clients are not even submitted, which shall have negative consequences for these clients.

Therefore it is the obligation of each client within that project to submit the unit(s) related documents together with the claim to assure that any errors or misinformation is avoided.

Any missing claims or claims submitted after the due date are not considered by the Court Committee.

What to do in case of Reactivation?
(Whether by the PREVIOUS DEVELOPER or by a NEW DEVELOPER)

In this case, clients can reach to an amicable settlement with the developer reactivating the
Project by following the below Procedure:

Register the claim with Freehold Mediation and Information Centre through info@freehold.info.
Schedule for a Situation Analysis meeting; the meeting provides up to date information about the current status used for this analysis are the Land Department, the Court, and a full market study (3+market report).
Schedule for an Option Analysis meeting; according to the chosen direction, this meeting provides insight in the costs, duration, the various results, and the success rate.
Use the Execution services handled by legal experts, real estate experts and financial consultants.
